Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.

In her order, the court pointed out that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Case

The court challenge center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.

Terms of Release

The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now comply with the terms of his release from custody in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
